Welcome to TailoredMail. By using our services, you agree to the following Terms of Service and Privacy Policy. These terms describe your responsibilities, our policies, and the standards for responsible email and SMS communication.
Terms of Service
1. Services
TailoredMail provides an online platform for creating and sending permission-based email and SMS campaigns. This includes tools for campaign building, analytics, automation, and subscriber management. Optional account support and professional services may be provided at our discretion.
2. Account Responsibilities
You are responsible for all activity within your account and agree to:
- Use TailoredMail only for lawful, compliant purposes.
- Maintain accurate billing and contact details.
- Keep login credentials confidential.
3. Acceptable Use & Compliance
You agree to comply with all applicable laws and TailoredMail’s sending policies:
- Opt-in only: All recipients must have explicitly consented to receive your
communications.
- No purchased or rented lists: You may not upload or send to lists obtained through
purchase or third parties.
- You must comply with anti-spam and privacy laws, including CAN-SPAM, TCPA, CASL,
and GDPR where applicable.
TailoredMail may suspend or terminate accounts that violate these terms, generate
excessive complaints, or pose risk to the platform.
4. Billing & Payment
- Payment for services is processed via a credit card on file with TailoredMail. The card will
be automatically charged at the beginning of each monthly service period.
- Where a credit card is not an option, a separate contractual agreement with specific
invoicing and payment terms must be signed prior to service activation.
- TailoredMail reserves the right to suspend or terminate accounts for failed or delinquent
payments.
5. Cancellation
This service operates on a month-to-month basis. Either party may cancel with 30 days’
written notice. If your cancellation overlaps a new billing cycle, fees for that month remain
due.
6. Data Ownership & Access
- You retain ownership of all subscriber data, campaign content, and uploaded assets.
- Upon cancellation, you may request an export of your data; TailoredMail will provide it in
standard electronic format within 30 days and then delete it from our systems.
- TailoredMail retains ownership of the platform, technology, and all related intellectual
property.
7. Liability & Indemnification
- You agree to indemnify and hold TailoredMail harmless from any claims resulting from
your content, data, or sending practices.
- TailoredMail is not liable for indirect, incidental, or consequential damages, including loss
of revenue or business.
8. Governing Law & Updates
These Terms are governed by the laws of the State of Washington, USA. TailoredMail may update these Terms periodically; continued use of the service implies acceptance of any
updates.
